Terms & Conditions

For the Ultimate Raffle
THE PRIZE: Buccaneer Adventures Niue Dive- Tamakautoga, Niue

The Competition is operated by the Promoter to which these conditions and terms apply wherein the Entrants purchase raffle tickets via the website www.niuedive.com

PROMOTER: Shannon and Krystal Hunter Tamakautoga, Niue

VALUATION (Owner’s Valuation) $430,000 NZD

Any stamp duty, together with solicitors fees for contracts along with any running costs of the business up until one month after draw date will be paid for by the promoter. (Or hand over of the business, whichever comes first).

Minimum number of paid entries 8600- Maximum 10,000

Raffle starts 1st May 2019.

If we do not reach the minimum ticket amount before February 29th 2020 the raffle may be extended or a monetary prize will be drawn instead

The competition is open to anyone over the age of 18.

There is no limit to the amount of tickets that can be bought per person.

Tickets have to be purchased online.

This competition is fully sanctioned by the Niuean government, we have obtained a yearly gambling licence by the Niuean Police for the duration of the raffle and has been approved by the treasury of Niue.

If the target value as stated in the terms and conditions is not met by the competition deadline, the competition promoter reserves the right to substitute the prize with a cash alternative which will be equal to the total amount of payments received minus reasonable administrative costs, not to exceed 25% of net payments received.

The raffle will be drawn by the Niue Chief of Police as per Niuean raffle laws and will be by random number generator.

Entrants will not receive a raffle ticket number with purchase, however their ticket/s will be designated a random number between 1- 10,000 for the draw.

The winner will be notified by phone and/or email within 14 days of draw.

The business will be completely owned by the winner as an as it state (minus the land which is leased and will be swapped over to the winners name after a court proceeding)

Anyone can own the business in Niue regardless of country of origin, however you must be able to pass normal immigration procedures, including police and medical checks. This is all at the winners cost and the complete immigration application is to be completed by the winner. Immigration paperwork will be attached to the competition email as a reference.

The promoter reserves the right to extend the Competition by a maximum of 6 months.

All Entrants must provide contact details to the Promoter, including an e mail address and phone number.

At the end of the draw, the Promoter will notify the winner that they have won the prize via email and/or phone.

Winner will be drawn via live stream on our facebook page. (Barring any technical difficulties)

The Promoter can not be held responsible for the Entrants failure to meet entry requirements for Niue or errors inaccuracies or omissions in the contact details provided by them.


If the business sells by private sale before the 31st of August 2019, then a monetary prize will be drawn in Lieu of the business.

The Promoter and Entrants acknowledge that the Competition, it’s administration and all associated activities are governed by Niuean Law and that the Promoter and Entrants recognise that the Courts in Niue shall have exclusive jurisdiction in the event of any dispute arising out of the Draw or its administration.

By entering the Competition, all Entrants confirm that all information and data that they have submitted is complete, up to date, accurate and true. The Promoter reserves the right to disqualify an entrant ( entirely at their own discretion) if there are reasonable grounds that the Entrant has acted in breach of any of the terms and conditions.

Privacy policy. The Entrants and the Promoters recognise that the Promoters may disclose the contact details of the Entrants for the purposes of the prevention of fraud, money laundering or other financial regulatory reasons.

The Entrant can be any person over the age of 18. (not including a limited company
or partnership or limited liability partnership, the promoters family, professional advisors or any such person connected with the competition or administration of the Competition in any way).

Entrants are deemed to have read the terms and conditions and agree to be bound by them.


1. The Competition is operated by the Promoter.
2. Entries will only be valid via the website
3. There is no limit to the amount of entries you can book (maximum 10,000 tickets will be sold)
4. All entries will become the property of the promoter and will not be returned.
5. The Promoter reserves the right to alter the terms and conditions at any time and for any reason.
6. The Promoter is not responsible or liable for the valuation and does not give warranty for the accuracy.
7. The Promoter will not be liable for any entrant who enters the draw unlawfully.
8. Only completed entries will be included in the draw.
9. The Entrants accept that the purchase of a ticket (plus booking fee) does not form a guarantee to win The Prize.
10. English is the only language in which the Entrant may submit an entry.
11. An entry will be declared void without a refund being given if The Entrant engages in any form of fraud (actual or apparent) fraudulent concealment, fraudulent representations, hacking or interference with the proper functioning website.

If the Promoter is unable to contact The Winner either by e mail or phone within the course of 7days, then The Promoter will be entitled to award the prize to the next entrant selected by drawing another winning entry at random. (the Alternate Winner) by random number generator.

The Winner will be required to attend the law offices in Niue to sign contracts during a required handover period, that must be within 1 month of draw.

The Prize will be transferred to the Winner free from mortgages and encumbrances and charges.

The winner will receive a handover period for training of 2 weeks with the promoter, the winner must be able to travel to Niue within 1 month of prize being drawn. If the winner is unable to travel within one month, an alternate winner may be drawn.

The Promoter will not be held liable for incomplete entries nor computer failures or any other such reason.

The competition rules do not form any contract nor venture between the Promoters and Entrant.

The Promoters decision is final and no correspondence will be entered into regarding the result.
